Eligibility And Requirements
Anyone is eligible to use the EB-5 program to attain conditional residency as long as they can meet the investment requirement of $1,000,000 or $500,000 and he or she is otherwise admissible to the United States. Investors come from all over the world from many different walks of life.
The applicant’s spouse and minor children can also apply for their conditional green card and subsequently for full citizenship in approximately 5 years.
REQUIREMENTS
According to current Federal regulations, the investor is expected to meet two main requirements to obtain permanent residency through the Pilot Program. These two primary requirements are:
- Prove the $1,000,000 or $500,000 investment has been made and that the money has been produced by lawful means; and
- Create 10 jobs by direct and/or indirect means by investing in a business formed or restructured after 1990.
One of the requirements of the Pilot Program is making sure your monetary investment has been acquired by lawful means. Because of this requirement, the USCIS may require that the investor show proof of the following:
- That the capital being invested has been acquired through legal means, keeping in mind that the source of capital can come by means of gifts, inheritance, or loans. Evidence that needs to be submitted may include but is not limited to the following:
- Bank Statements
- Investment Statements
- Profits or proceeds from sale of real estate
- Profits and earnings from a business
- Profits or earnings from stock or other investments
- Documents showing ownership of real estate or business
- Loan, mortgage, promissory note, security agreement, or other evidence of borrowing
- Tax returns
- Proof of being an “accredited investor”
- Has a net worth individually or jointly in excess of USD 1,000,000; and
- Has an income that exceeds USD 200,000 for the most recent years; or
- Jointly with a spouse, for the same period, in excess of USD 300,000
- You also may need to supply a variety of personal documents
- Legal copies of passports
- Investor’s resume
- Copies of academic diplomas
- Corporate Organization documents, if you own a business
- Certified copies of birth certificates, marriage certificates, divorce decrees, and death certificates if applicable
- Certified copy of military record
- Certified copy of police record
