The Investment Process

California EB-5

The process is not extremely difficult to understand but if explained incorrectly it can be confusing. For this reason, we at Northern California Regional Center will attempt to explain the process in its simplest form.

To begin, an investor invests in a Northern California Regional Center project and the investment is deposited into an escrow account. The immigrant investor then submits an I-526 petition to the United States Citizenship and Immigration Service. If the United States Citizenship and Immigration Services denies the I-526 petition, the investment is promptly refunded. If the I-526 petition is approved the investment is released from escrow for use in the project.

Within 21 to 24 months of the initial investment, the immigrant investor must file an I-829 Petition with the United States Citizenship and Immigration Services. Once the I-829 is approved, the United States Citizenship and Immigration Services removes the conditions from the conditional green card. Within 90 days of the 5 year anniversary of I-829 approval, the immigrant investor can apply for full United States citizenship.

The immigration process can be difficult to comprehend in a written format, a flowchart can help you you understand it more easily. Click here to view flowchart.
